However, an NJIT officer or employee or special NJIT officer or employee may accept compensation from sources other than the State for published work(s) on matters unrelated to his/her official duties created on his/her own time and with non-NJIT resources.
It is important to remember that:
- information not generally available to members of the public, which was acquired through the course of the NJIT officer's or employee’s appointment or employment, may not be disclosed, whether for pecuniary gain or not; and
- no NJIT officer or employee or special NJIT officer or employee may use his/her official title in soliciting and/or receiving compensation for a published work.
Prior to agreeing to accept or accepting any compensation from a source other than the State for any published work, an NJIT officer or employee or special NJIT officer or employee must complete the State of New Jersey Outside Activity Questionnaire and receive permission from his/her immediate supervisor and the NJIT Ethics Liaison Officer. Approvals will be based on applicable law, ethics regulations, and NJIT’s Supplemental Code of Ethics.
Scholarly Capacity Exception:
An NJIT employee who serves at NJIT in a scholarly capacity may require the use of his or her own published work(s) in a course that he or she teaches. However, monies received by the employee or relative resulting from such use must be donated to NJIT.
An NJIT employee who serves at NJIT in a scholarly capacity may accept compensation for the use of his or her published work(s) in a course that he or she does not teach, provided that he or she was not involved in the selection of the published work for use in that course.
