Limited English Proficiency Policy

1.0 Purpose of the Policy

In accordance with the prohibition against discrimination on the basis of national origin, it is the policy of NJIT not to discriminate against any individual with limited English proficiency (“LEP”).

2.0 Communicating the Policy

The Policy is communicated using the following methods of communication:

  • Publication of the policy on the Official Catalog of University Policies webpage
  • Postings in public areas such as the Department of Human Resources, Office of the Dean of Students, and Admissions


3.0 Limited English Proficiency (LEP) Policy

NJIT, as a longstanding bastion of diverse thinking and individuals, has always striven to uphold its core values which include integrity, civility, social responsibility, diversity and communication. In furtherance of these values and in conformance with federal and state anti-discrimination laws, NJIT is taking steps to ensure its programs and activities are accessible to LEP individuals:

  1. LEP persons are defined as individuals who do not speak English as their primary language and who have a limited ability to read, write, speak, or understand English. 
  2. NJIT, upon request and on a case-by-case basis, may provide LEP individuals with assistance through available and appropriate non-English language resources, such as translation or interpretive services, so long as the assistance does not unreasonably interfere with academic standards or create an undue burden on university resources. 
  3. The Chief Diversity Officer shall maintain a list of non-English language resources for LEP individuals and disseminate the list on a regular basis to university offices and departments, as well as regularly assess the efficacy of the non-English language resources. 
  4. Individuals who believe they have not been provided reasonable access to LEP services may appeal to the Provost, or their designee, within 60 days of the denial of request for LEP services. 
  5. The Chief Diversity Officer, with support by the Office of Human Resources and Office of the Dean of Students, shall be responsible for the coordination of services arising from the implementation of this policy.
  6. Nothing herein is intended to apply to NJIT’s delivery of academic programs, for which English language proficiency requirements are applicable, nor employment positions for which English language proficiency is a requirement of the position.
  7. A review of this policy and services offered shall take place every three years by the Chief Diversity Officer, or by their designation, the Committee for Inclusive Excellence (with final review by the Chief Diversity Officer).


4.0 LEP Resources

The following list has been provided as assistance to LEP persons[1]:
